DOGE is no longer able to access student loan data. The University of California Student Association has filed a suit after reports that DOGE had accessed federal student loan information.

The Education Department has agreed to prevent DOGE, the commission led by Elon Musk, that Donald Trump established by executive order on 20 January 2025, from accessing sensitive data such as student loan information while a court case is being heard.

DOGE is no longer able to access student loan data

The University of California Student Association has filed a lawsuit after reports that DOGE could access federal student loan information.

The lawsuit claims the Department violated the Privacy Act when it provided sensitive information to DOGE, including student social security numbers and tax data. The Privacy Act of 1974 limits how federal agencies collect and share people’s personal information.

A Tuesday agreement between the Department of Education and the Student Association prevents DOGE from accessing several systems, including the National Student Loan Data System and Aid Awareness and Application Processing. This ban will last until 17 February. The agreement allows D.C. district court judge Randolph Moss to schedule a hearing for 14 February on restraining or preventing DOGE from gaining access to the information.

During a Tuesday hearing, Moss was skeptical about the claims of the student’s association. He said he didn’t see how DOGE accessing student loan data could cause harm.

Another D.C. District Court Judge rejected a similar attempt by an employee union to block DOGE from accessing Labor Department data after finding that the union lacked the standing to sue. Expressed sympathy for the concerns about privacy risks.

On Saturday, a federal judge in Manhattan prevented the Treasury Department from giving DOGE access to sensitive records. The judge found that it placed the data at risk of leaks or cyberattacks. The judge also determined that the states challenging the arrangement would likely win their case.

Last Thursday, 16 Democratic Senators, led by Chuck Schumer, the Senate’s minority leader, investigated DOGE’s use of student loan data.

The senators wrote to Denise Carter, acting secretary of the Department of Education, expressing their concern about the report and questioning whether the Trump Administration had abused the data.
